Y es que en la actividad ordinaria del despacho no son pocas las consultas o procedimientos judiciales que tienen por objeto las relaciones de vecindad que surgen como consecuencia de la vida en Comunidad a través de la denominada Propiedad Horizontal, que no sólo está extendida en las poblaciones de ciertos habitantes, sino también en nuestros queridos pueblos en los que, cada vez más, la opción de acceso a la vivienda es adquirir una de ellas en régimen de Propiedad Horizontal;  o bien, para desarrollar un negocio en un local perteneciente a una Comunidad de Propietarios.

Ello nos obliga a respetar una serie de normas de convivencia para que el disfrute de la propiedad se realice de una manera ordenada, sin que el propietario pueda realizar lo que se le antoje “en el legítimo ejercicio de su derecho de propiedad”. Dichas normas están recogidas, principalmente en la Ley de Propiedad Horizontal, que data de 1960, si bien ha sufrido una serie de modificaciones, especialmente relevantes son las realizadas por la Ley 8/1999 y la Ley 8/2013, en la que se actualiza el texto sobre todo para dotar a la Comunidad de mayor agilidad a la hora de tomar decisiones, restringiendo la necesidad de unanimidad a la hora de adoptar acuerdos, así como adaptarla a los dictados de las nuevas formas de construcción, más eficientes, así como a la adaptación de los edificios a las nuevas energías.

Por lo tanto, no son únicamente las clásicas cuestiones referentes a las reclamaciones a los propietarios morosos, la determinación de la mayoría necesaria para la instalación de un ascensor, o cualquier otro sistema para remover las barreras arquitectónicas, la cesación de actividades molestas, la instalación de nuevos sistemas de climatización, las obras que modifican la estructura de la fachada, etc. que, por haber sido frecuentemente resueltas por la jurisprudencia, existe un cuerpo doctrinal que ha pasado al propio texto de la Ley, sino que existen muchas otras cuestiones que siguen planteando problemas jurídicos a los propietarios y a la propias Comunidades, sobre todo en lo relativo al uso y utilización de los elementos comunes.

A lo anterior puede añadirse los problemas y disputas surgidas de las nuevas formas de uso de las viviendas en régimen de propiedad horizontal, como son las plataformas digitales de alquiler turístico, como Airbnb, que no son siempre bienvenidas por los propietarios y que el legislador está promoviendo la regulación de esta nueva realidad, contando para ello, como parece, con la Junta de Propietarios.

En definitiva, no siempre somos conscientes de la ampliación o restricción de nuestro derecho de propiedad sobre una vivienda o un local derivado del régimen de propiedad horizontal, de lo importante que es conocer los estatutos de la comunidad donde realizamos la inversión de nuestra vida, y que tanta influencia tiene en la tranquilidad y disfrute de nuestro derecho.
