Hoy en día sigue siendo muy común la celebración de matrimonios bajo el dogma de la fe cristiana. El matrimonio es entendido por la Iglesia católica como alianza, por la que el varón y la mujer constituyen entre sí un consorcio para toda la vida.

No obstante el carácter indisoluble del matrimonio, según la fe cristiana, el vínculo matrimonial puede considerarse no válido.

Si se tiene dudas acerca de la validez de dicho matrimonio y una convicción moral y  creencia religiosa de que el mismo pueda resultar inválido, es posible presentar una demanda de nulidad matrimonial ante los Tribunales Eclesiásticos.

El proceso canónico no es incompatible con el proceso civil de separación o de divorcio, dado que la competencia de la nulidad del matrimonio canónico corresponde a la Iglesia y la separación o divorcio civiles  al Estado. El Proceso civil  puede simultanearse o incluso anticiparse al proceso canónico.

El proceso de nulidad que se inicie, se decidirá generalmente sobre la validez o no del matrimonio celebrado y en un proceso civil se decidirá sobre cuestiones sobre: la patria potestad, la custodia de los hijos, uso y disfrute del domicilio familiar, pensiones de alimentos y compensatoria, en su caso, y otras cuestiones de carácter patrimonial.

La sentencia canónica que declare la nulidad del matrimonio puede tener eficacia civil tras un sencillo proceso ante el Juzgado de Primera Instancia competente.

La resolución dictada por un Tribunal eclesiástico es reconocida por el Estado español, y en el caso de declarar la nulidad, produciría el efecto de tener por no formalizado el matrimonio.

REFORMA DEL DERECHO CANÓNICO

El actual Papa, Francisco, ha introducido una reforma sustancial en dicho proceso de nulidad a través del documento denominado Mitis Iudex Dominus Iesus.

Son los aspectos esenciales de la reforma introducida, entre otros los siguientes:

  • Facilitar el acceso de los fieles a los tribunales eclesiásticos.
  • Suprimir la necesidad de dictado de doble sentencia conforme con la nulidad, bastando una única sentencia declarativa de nulidad.
  • Crear el proceso más breve para aquellos casos en los que la nulidad se aprecia de una forma más evidente,
  • Disminuir del coste económico del proceso de nulidad.

CAUSAS DE NULIDAD

Para poder determinar si un matrimonio es nulo es preciso acudir al estudio de cada situación particular y verificar si existen las condiciones establecidas por el Derecho Canónico para presentar la causa de nulidad matrimonial ante la Iglesia.

Es conveniente pues elegir un abogado especialista en derecho matrimonial canónico.

Un matrimonio será válido si ha sido realizado entre personas hábiles y que sean capaces de prestar consentimiento, pues en caso contrario estaríamos ante un caso de nulidad.

Las causas de nulidad se pueden concretar en tres: el defecto de forma, el matrimonio celebrado con impedimento o el contraído con vicio de consentimiento.

A modo de ejemplo,  son nulidades derivadas de impedimentos: el Impedimento de edad, Impedimento de impotencia,  de rapto, de crimen, de consanguinidad, de afinidad o de parentesco legal, entre otros.

Dentro de las nulidades por vicio de consentimiento se encontrarían: la Nulidad por carecer de uso de razón, por incapacidad de asumir las obligaciones esenciales del matrimonio, por Ignorancia de las propiedades esenciales del matrimonio, simulación total del matrimonio, o contraído por violencia o por miedo grave, por ejemplo.

PROCESOS DE  NULIDAD MATRIMONIAL

En caso de que se concluya afirmativamente la existencia de causa de nulidad, hay que acudir a un proceso  judicial ante el juez competente, al que se le deben aportar las pruebas pertinentes, y en el que deben intervenir las partes, el defensor del vínculo y, en algunos casos, el promotor de justicia.

El proceso de nulidad matrimonial se inicia mediante demanda que será interpuesta ante el  tribunal eclesiástico de la diócesis donde se celebró el matrimonio.

El proceso ante el que se tramitará la nulidad será normalmente el PROCESO ORDINARIO.

En caso de presentarse por ambas partes de mutuo acuerdo se podrá tramitar a través del proceso denominado BREVE, siempre que se den dos presupuestos:

  • La demanda ha de ser presentada por ambos cónyuges o por uno de ellos con el consentimiento del otro;
  • Deben concurrir circunstancias de hechos y personas, corroboradas por testimonios y documentos, que no requieran una investigación o una instrucción más pormenorizada, y que hagan manifiesta la nulidad.

TRÁMITES DEL PROCESO

Admitida a trámite la demanda se dará traslado al otro cónyuge para que pueda actuar en el proceso. Eligiendo éste cual quiere que sea su participación en el mismo, oponiéndose, ausentándose o sometiéndose a la justicia del tribunal.

Pruebas comunes que tienen lugar en el proceso de nulidad serán: el interrogatorio de los esposos, la declaración de testigos designados por las partes o por defensor del vínculo y las pruebas pericial y documental.

Tras la práctica de las pruebas se inicia la discusión de la causa que tendrá lugar normalmente de modo escrito, valorando la prueba practicada, dando paso a las alegaciones oportunas.

El proceso termina con el pronunciamiento de sentencia por el Tribunal, que para poder declarar la nulidad matrimonial debe tener certeza moral.
