Las personas incluidas en el Régimen General de la Seguridad Social, afiliadas y en alta o situación asimilada al alta (como por ejemplo, en situación legal de desempleo, total o subsidiario, así como en paro involuntario, siempre que se mantenga inscrito como desempleado) deben reunir una serie de requisitos si quieren tener derecho a la percepción de una prestación de jubilación, como por ejemplo: haber cumplido la edad para poder jubilarse o en su caso tener un periodo mínimo de cotización.

¿Cómo se calcula la pensión?

El requisito de la edad ha ido variando a partir de enero de 2013, ampliándose la edad requerida y el período de cotización para poder tener derecho. En 2017 se exigía tener 65 años y 36 años cotizados. Cada año que pasa los requisitos se van endureciendo hasta que en 2027 se exigirá tener entre 65 y 67 años y sumar 38 años y 6 meses  de cotización a la Tesorería.

Para el cálculo de nuestra futura pensión se tienen en cuenta un período mínimo de cotización establecido en 15 años, así como un período de cotización específico de dos años que deben estar comprendidos dentro de los 15 años inmediatamente anteriores al momento de la solicitud.

¿Cómo obtener el informe de vida laboral?

De ahí la importancia de los años cotizados. Muchas veces la Tesorería nos envía informes de la vida laboral e informe de las bases de cotización y no las revisamos, ya que damos por sentado de que serán correctas. Pero en ocasiones, se pueden producir errores y debemos comprobar que los datos recogidos son exactos. En cualquier momento podemos acceder a nuestra información, porque todo trabajador tiene derecho a solicitar a la Tesorería General de la Seguridad Social un informe histórico de la vida laboral y un certificado histórico de las bases de cotización.

  • Esta solicitud se puede hacer a través de la Sede Electrónica mediante el servicio “Informe de bases cotización” vía SMS, cumplimentando el formulario previsto al efecto, siendo necesario que los datos de autenticación coincidan exactamente con los que tiene la Tesorería. A continuación se recibe un código en nuestro móvil, que nos permite obtener, imprimir y consultar todas nuestras bases de cotización.
  • A través de la misma Sede Electrónica, señalando la opción “ciudadanos-servicios” sin certificado digital, que remitirán al domicilio del solicitante.
  • Y el trámite se agiliza y se obtiene directamente si se tiene el certificado digital, ya que la información la tenemos al momento.
  • Telefónicamente llamando al teléfono 901.50.20.50 marcando la opción “información general”, e ir contestando los datos que nos irán pidiendo.

¿Qué pasa si hay algún error en nuestra vida laboral?

Si al recibir el informe comprobamos que la empresa no ha cotizado por nosotros porque no ha comunicado el alta, se puede presentar denuncia por falta de alta en la Inspección de Trabajo y Seguridad Social de la provincia donde radique el centro de trabajo. Si ya no se prestan  servicios en la empresa y no se tiene constatación directa del parte de alta, deberíamos aportar el contrato de trabajo, recibo de salarios, actos de conciliación o sentencia que la reconozca, y con la documentación reunida solo cabrá recurrir al Jurisdicción de los social demandando el reconocimiento de dicha relación laboral.

Si observamos lagunas en ciertos periodos a lo largo de nuestra vida laboral, es importante saber que se rellenarían esas lagunas de cotización con las bases mínimas existentes en cada momento, es decir con las correspondientes al SMI del mes en el que se encuentren.

Si en el informe de las bases de cotización de nuestra vida laboral aparecen periodos en los que, habiendo estado de alta, la cotización que figura aparece como cero o con lagunas de cotización o cotizaciones inferiores a las reales puede significar, según la Tesorería, que el trabajador no ha cotizado o ha cotizado por menor importe.

Si nos hemos visto perjudicados por cualquier de esos errores, deberíamos iniciar una reclamación aportando cualquier medio de prueba que acredite que hemos cotizado o que el importe de la cotización es superior a la indicada en el informe emitido por la Seguridad Social. Es importante conservar todas las nóminas y pedir a la empresa copia de los TCs, certificado de empresa, contratos de trabajo… Una vez reunida toda la documentación se puede presentar un escrito remitido a recaudación de la Administración de la Tesorería de la Seguridad Social que nos corresponde, explicando nuestra situación y los errores detectados en nuestras bases de cotización.

En cualquier caso, lo que queremos transmitir es la importancia de revisar la documentación que nos remiten los Organismos Públicos, y conservar la que nos pueda ser útil de cara al cálculo y reconocimiento de nuestra pensión de jubilación, ya que los requisitos de percepción se van endureciendo año tras años. Una buena planificación y estudio de nuestra situación laboral nos librará de futuros quebraderos de cabeza.
